Terms of Use

The following are the terms and conditions (the “Terms and Conditions”) of Fenton Portable Buildings Limited (“We”, “Us” or “FPBuildings”) and sets out the conditions on which we do business with you (the “Customer” or “Prospective Customer”). It specifically pertains to how do we business through our Internet website (the “Website”). All reference to goods refers to official products listed and supplied by Fenton Portable Buildings.

These terms apply to any goods provided by FPBuildings, registered office Ormonde Street, Fenton, Stoke-on-Trent, Staffordshire, registered company number 2800773.

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE PLACING AN ORDER WITH US.


1. Ordering of Goods

1.1 All orders of goods from FPbuildings are subject to availability and acceptance by us. We will contact you in the event that any goods you have ordered are unavailable. You will have the option either to wait until the goods in question are available from stock or to cancel your order.

1.2 Orders are only eligible for free delivery and erection if they fall within a 20 mile radius of our factory in Fenton, Stoke-on-Trent. For orders outside of this area, please contact us for delivery prices. For orders placed out of this area, we will contact you before processing your order to confirm the delivery price.

1.3  We currently accept the following payment methods ("Payment Method") for orders: Online - Credit or Debit cards, cheques or cash.

1.4 WE DO NOT STORE DETAILS ABOUT YOUR CREDIT CARDS.

1.5 After an order is placed, we will contact you to confirm your order, door and window positions, offer an optional extras and confirm delivery.

1.6 Only after details have been confirmed will we take payment in full.

1.7 Orders cannot be accepted from customers under the age of eighteen (18) years.

2. Order and Payment

2.1 All Buildings are to be paid for, in full, a minimum of 7 days before delivery. Failure to do so will result in non-delivery of goods.

2.2 Payments can be made in cash, by cheque or by credit or debit card. Telephone payments can only be accepted if the delivery address of your new garden building is the same as the payment card’s registered address.

2.3 In cases of cancellation, deposits may be retained at the discretion of the company.

2.4 All goods remain the property of Fenton Portable Buildings Limited until paid for in full.


3. Pricing

3.1 All prices of goods quoted on the Website are inclusive of VAT at the prevailing rate and include treatment and our free delivery and erection service.

3.2 Orders placed for delivery out of our 20 miles delivery radius will incur a delivery charge.

3.3 We reserve the right to change our prices for goods and delivery at anytime without any prior notification.

3.4 When you have contacted us to place an order of goods, the prices quoted will remain as agreed for a period of not more than 30 days from the time of first contact regarding the order or until we have received payment from you.


4. Base Preparation

A firm, Square, Level base is essential for your new garden building. Without this, the lifespan of your buildings will be severly affected. Any return calls to carry out erection due to inadequate base work will be charged for at our standard hourly rate. A concrete or slab base is the best method. Alternatively, if the ground is level and firm, concrete or wooden bearers will be sufficient. Please ensure that your base is at least 6 inches clear of any walls or fences and that trees or bushes are not obstructing the area of your shed.


 5. Access

It is the customers responsibility to report ant problems with access prior to delivery, i.e. height restrictions, sharps bends, steps etc. If access is required through a neighbours property, please get permission prior to delivery. Please note that, due to health and safety regulations and insurance restrictions, we are unable to lift your garden building panels over high walls, fences, garage roofs etc. Any return calls to carry out erection due to access issues will be charged for at our standard hourly rate.

 
6. Care of your building

Fenton Portable Buildings strongly recommends that you retreat your building as soon as possible after delivery with a good quality preservative such as the spirit based preserver available from our sales office. The water-based factory treatment acts as a base coat only. Your building should then be treated at least once a year thereafter, again using a good quality preservative.

 
7. Guarantee

Any installation problems or complaints must be reported in writing within three days of delivery or collection of your garden building.

Our buildings are guaranteed for twelve months from the date of delivery/collection against defects in material and workmanship. This guarantee does not cover faults caused by:

• work not carried out by Fenton Portable Buildings
• movement or subsidence of your base
• damage caused by excessive weather conditions
• by movement of timber as a natural product

Your guarantee may become invalid if any work or repair is carried out on your garden building by anyone other than Fenton Portable Buildings or if the building is structurally altered in any way.

This guarantee does not affect your statutory rights.

 
8. Disclaimer

8.1 Whilst we agree to use our reasonable endeavours to ensure that the Website is fully operational and error-free we cannot guarantee this and therefore accept no responsibility for any defects and/or interruption of the Website and shall be released from our obligations under these Terms and Conditions in the event of any cause beyond our reasonable control which renders the provision of the Website impossible or impractical.

8.2 We exclude, to the fullest extent permitted by applicable laws, all liability of any claims, losses, demands and damages arising directly or indirectly out of or in any way connected with the goods supplied by FPBuildings or your use or inability to access the Website. This exclusion shall apply in respect of, without limitation, any costs, loss of profits, loss of contracts or business opportunity, loss of data and any other consequential, incidental, special or punitive damages, even if we have been advised of the possibility of such damages, whether arising in contract, tort, under statute or otherwise or due to representations (other than fraudulent or negligent misrepresentations) PROVIDED THAT nothing contained in these Terms and Conditions affects or will affect the statutory rights of the customer or the recipient in relation to the quality, fitness or description of the goods supplied.

9. General

9.1 We reserve the right to supplement and amend the Terms and Conditions on which you are permitted access to the Website from time to time. Any changes will be posted on the Website and it is your responsibility as a customer to review any changes on accessing the Website. Changes will be effective five (5) hours after the posting of any such change.

9.2 Additionally, we reserve the right to suspend, restrict or terminate access to the Website for any reason at any time.

9.3 These Terms and Conditions shall be deemed to include all other notices, policies, disclaimers and other terms contained in the Website, provided that in the event of a conflict between any other terms, these Terms and Conditions shall prevail. If any of these Terms and Conditions is held to be invalid or enforceable, the remaining provisions shall remain in full force and effect.

9.4 No waiver by us shall be construed as a waiver of any preceding or succeeding breach of any provision.

9.5 If any part of these Terms and Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from the Terms and Conditions and shall not affect the validity and enforceability of any of the remaining provisions of the Terms and Conditions.

9.6 We shall ensure that we comply with the requirement of all current data protection legislation including, without limitation, the Data Protection Act 1998 (as replaced, modified or re-enacted from time to time). We shall only use personal data received from you for the purpose of fulfilling our obligations under these Terms and Conditions.

9.7 These Terms and Conditions shall be governed by and construed in accordance with English law and the parties agree to submit to the exclusive jurisdiction of the English courts.

10. Website Content and Copyright

10.1 All Website content including text, picture images, logos, symbols, HTML or any programming code is protected under international copyright law ©  to FPbuildings or our suppliers and service providers.

10.2 Use of any content on the Website outside of it's specified purpose will be deemed an infringement of copyright law and will be prosecuted as such.

10.3 Claims of ownership without prior agreement with FPBuildings or with intent to falsify identity or steal intellectual property will be deemed an infringement of copyright law and will be prosecuted as such.
